1. Introduction

These Terms of Service ("Terms") govern your use of the OrderMadd platform, website, and services (collectively, the "Service") operated by OrderMadd ("we", "us", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

2. Definitions

"Business" means a cafe, restaurant, food stall, or other food business that uses OrderMadd to accept orders.
"Customer" means an end user who places orders through the OrderMadd platform.
"Account" means a registered account on the OrderMadd platform.

3. Accounts

To use certain features of the Service, you must create an Account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your Account.

You must provide accurate, current, and complete information during registration and keep your Account information up to date.

4. Service Plans & Billing

OrderMadd offers several subscription plans, including a free Starter plan. Paid plans are billed monthly and prices are listed on our Pricing page.

Paid subscriptions renew automatically each month unless cancelled.
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
We do not charge commission on orders. Standard payment processing fees (e.g. Stripe fees) apply and are charged by the payment processor, not by OrderMadd.
We reserve the right to change pricing with 30 days' notice.

5. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
Attempt to gain unauthorised access to any part of the Service.
Interfere with or disrupt the integrity or performance of the Service.
Upload or transmit malicious code, viruses, or harmful content.
Use the Service to sell items that are illegal, unsafe, or prohibited.

6. Business Responsibilities

If you are a Business using OrderMadd, you are responsible for:

Ensuring your menu items, descriptions, and prices are accurate and up to date.
Complying with all applicable food safety, hygiene, and trading standards regulations.
Fulfilling orders placed through the platform in a timely manner.
Handling customer complaints and refund requests for your products.

7. Intellectual Property

The Service, including its design, features, and content, is owned by OrderMadd and protected by intellectual property laws. You retain ownership of any content you upload to the Service (e.g. menu items, logos, images).

By uploading content, you grant us a non-exclusive licence to use, display, and distribute that content solely for the purpose of operating the Service.

8. Limitation of Liability

To the maximum extent permitted by law, OrderMadd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.

Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Termination

We may suspend or terminate your Account if you breach these Terms or if we reasonably believe your use of the Service poses a risk to us or other users. You may close your Account at any time by contacting us.

10. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
